Terms and Conditions

Article 1 – Subject Matter

1.1 Definition of the Parties

These General Terms and Conditions of Sale govern the commercial relationship between Quickpartitions and its customers. A contract is formed upon payment confirmation, at which point the General Terms and Conditions of Sale are deemed to have been read and accepted.

1.2 Validity

These General Terms and Conditions of Sale may be amended at any time and without prior notice by Quickpartitions, and shall apply immediately to existing and future services. Any purchase on the Quickpartitions website implies unconditional acceptance of these General Terms and Conditions of Sale and compliance with the provisions of French Intellectual Property Law.

Article 2 – Description of Services

2.1 Digital Sheet Music

Quickpartitions distributes digitised sheet music available for printing or download in PDF format. This can be done either immediately after purchase or by logging into the customer's account at a later date. For more information on account security, please refer to the "Privacy" section.

Visual previews, audio files and sheet music may be modified without prior notice and are provided for information purposes only; Quickpartitions accepts no liability in this regard.

2.2 System Requirements

The customer must have access to a computer or compatible device, a printer and an internet connection. The quality of these elements may affect the performance of our service.

Quickpartitions undertakes to implement all reasonable measures to provide users with reliable and fast access to its services, available 24/7, subject to accidental interruptions or those required for the proper operation of the service. No compensation shall be due in the event of such interruption. Quickpartitions shall not be held liable for any malfunctions resulting from incompatibility with the customer's hardware, low-bandwidth connections, or failure to update software and browsers.

2.3 Registration and Invoicing

Prior to their first purchase, customers are required to register by completing a form with the information strictly necessary for invoicing purposes. A confirmation email will be sent to the customer upon registration, containing their login credentials.

Quickpartitions reserves the right to require prior payment guarantees before validating a purchase, or to cancel an order placed by a customer with whom a payment dispute is pending.

2.4 Delivery

Quickpartitions undertakes to make sheet music available as soon as payment is confirmed. Customers may print or download their purchased sheet music by logging into their account using their email address and password. Purchases will remain available in the customer's account indefinitely.

Sheet music is available in multiple keys. The various transpositions are accessible from the customer's account following purchase.

Songbooks sold through our website will be dispatched by tracked mail within 72 hours of purchase.

Article 3 – Payment

3.1 Pricing

All prices are in euros. Sheet music is sold at a unit price of €4.73 excl. VAT, or €2.83 excl. VAT for classical music scores. The applicable French VAT rate of 5.5% is added, resulting in an all-inclusive price of €4.99 or €2.99 respectively. Prices are subject to change without prior notice.

In accordance with copyright regulations, Quickpartitions pays a percentage of each sale to the publishers representing the composers and songwriters.

3.2 Credits, Promotions and Discounts

Store credits may be used for a period of one year from the date of issue. Promotional offers may be made available on an occasional basis. They are valid from the first day at 00:00 (Paris time, France) until the last day at 00:00 (Paris time, France), the date and time of the bank transaction being the reference. Volume discounts are applied based on the number of titles purchased and are calculated on the unit price excl. VAT of each score.

A 5% discount applies to purchases of 2 scores, 10% for 4 scores, 15% for 6 scores, and 20% for 8 or more scores. Permanent discounts cannot be combined with promotional discounts.

Promotions and discounts are subject to change without prior notice. Sheet music purchased at a discounted or promotional price will be refunded at the price paid, even if the refund is processed outside the relevant promotional period.

3.3 Transaction Security

Accepted payment methods include: Carte Bleue, Visa, Mastercard, American Express and PayPal. Quickpartitions does not accept payment by cheque or bank transfer. Transaction security is provided by BANQUE POPULAIRE's online payment service: Cyberplus.

Quickpartitions does not store any banking details. All data is encrypted and Quickpartitions has no access to it.

Article 4 – Legal Information

All rights of the authors, composers and publishers of the protected works reproduced and made available on the Quickpartitions website are reserved. Unless expressly authorised, any use of the works other than reproduction for private, non-collective purposes and individual private consultation is strictly prohibited.

The customer is expressly prohibited from:

Access to the online service in any form does not constitute a transfer of intellectual property rights of any kind to the user. The user is furthermore prohibited from infringing in any way the reproduction, representation and other rights held by Quickpartitions, including those arising under Articles L.342-1 et seq. of the French Intellectual Property Code relating to databases.

Trademarks, logos, illustrations and text are the property of Quickpartitions or its partners. Any total or partial reproduction, representation, modification or alteration without the express authorisation of Quickpartitions and/or the relevant rights holders is strictly prohibited and may give rise to legal proceedings.

PDF Printing

Although our system allows sheet music to be saved as a digital file (PDF), the customer undertakes not to share such files with third parties or to use them for any commercial purpose.

The distribution of copyright-protected files constitutes an act of infringement punishable under French criminal law (Article L.335-2 of the Intellectual Property Code), carrying penalties of up to 3 years' imprisonment and a fine of €300,000.

Article 5 – Withdrawal and Claims

5.1 Terms

Under the conditions set out in Article L. 121-16 of the French Consumer Code, and in the context of services provided exclusively through one or more distance communication technologies, the user has a right of withdrawal of thirty (30) clear days from the date of acceptance of the offer. Where this thirty (30)-day period expires on a Saturday, Sunday or public holiday, it is extended to the next working day. However, pursuant to Article L. 121-20-2 1° of the French Consumer Code, the right of withdrawal may not be exercised in respect of sheet music that has already been downloaded.

The customer must contact technical support. Quickpartitions will process the refund as promptly as possible, provided the customer has not downloaded and/or attempted to print all or part of their purchase.

In the event of a dispute or complaint, the Technical Support team has sole authority to approve a payment cancellation or issue a store credit. Article 6 – Governing Law and Jurisdiction

These General Terms and Conditions of Sale are governed by French law, without prejudice to the application of any mandatory protective provisions that a foreign court may apply at the request of a consumer from the relevant country.

Should any clause or provision of these General Terms and Conditions of Sale be declared null and void or unlawful by a final court decision, such nullity or unlawfulness shall have no effect on the remaining clauses or provisions, which shall continue to apply in full.

Any dispute relating to the formation, performance or termination of the contractual obligations between the parties that cannot be resolved by mutual agreement shall be referred to the courts of Grenoble.
